Default Terms of Service self written

I know people tend to copy and paste from other sites then really get down on it and rewrite the TOS. I'd like to know is there any free form of doing this that isnt so...illegal feeling? I've seen lawyers offering to write up TOS for as cheap as 28 GBP and as much as 150 GBP. I'd like to know what is the best. If in the event there is a law suit it would be better to have the lawyer write out the TOS im guessing.
